The present general terms and conditions of use of the website (“GTC”) have been created by VERNICOS YACHTS S.A (hereinafter “the Company”), which respects the privacy of the website visitors (hereinafter “the Visitor”) and complies with the applicable laws on the protection of personal data.
The present GTC are drawn up in Greek, English, Frenchand German and any other version thereof is a non-binding translation of the official Greek text. Visitors may access the present GTC at any time from their terminal device and it is recommended to check them before using the website.
1.VISITOR OBLIGATIONS
1.1 TheVisitor shall use the www.vernicosyachts.com website network in such a way that no damage or overload shall be caused thereto and its purpose not to be compromised or circumvented. In addition, they shall refrain from acts that may result in criminal prosecution or any civil or administrative proceedings against VERNICOS YACHTS S.A. for acts contrary to the applicable legislation.
1.2 The Visitor shall not infringe any form of Intellectual Property Rights of third parties.
1.3 The Visitor shall strictly adhere to the terms and conditions of use of the Company’s website, as well as the applicable regulations for the protection of personal data of visitors to its websites.
1.4 The Visitor shall provide complete, true and correct information (name, surname, e- mail, telephone number) in order for the Company to be able to communicate therewith to fulfill the visitor’s requests. In any case, the information provided by the Visitor is provided under their responsibility, for communication purposes and according to their declaration.
2. AVAILABILITY, CHANGE AND DISCONTINUANCE OF THE WEBSITE
2.1 The Website Visitor shall not demand permanent and uninterrupted availability of the Website.
2.2 Furthermore, the Company has the right to interrupt the services at any time and permanently for any reason without prior notice.
2.3The Company may, for technical reasons, interrupt the services on a temporary basis, after informing the Users prior to the discontinuation of the service through the website or by other means.
2.4 The Company reserves the right to modify the website at any time in a reasonable way for the User, for example, in order to improve it.
3.1 The Company shall bear no liability with respect to the Visitor during their use of the website other than the one possibly stated in the present Terms and Conditions of Use.
3.2 The Company shall not be responsible for the correctness and completeness of any information provided by the User during the use of the services of the website.
3.3 If through the use of the website or the sending of data the Visitor is harmed, the Company shall be liable only if this is caused by its fraudulent intent or gross negligence. The Company shall not be liable for the loss of the User’s data in any case and in anyway.
3.4 The Company shall not be liable if for any reason it ceases to provide services in whole or in part, temporarily or permanently.
3.5 The Company does not endorse and is not responsible for third party content and links to third party websites on its website.
3.6The Company reserves the full right to delete visitor data if the Company’s policy requires it.
3.7The prices shown are indicative, even at the time of posting, in no way shall they bind the Company, and the Company bears no responsibility for any change thereof.
3.8 The photos of the products are indicative and may not correspond to reality.Therefore, and in general, the company shall not be responsible in case of deviation of the photo, color, quality or appearance of the product on the website from its actual image.
3.9The dates of availability are indicative, even at the time of posting, and the Company shall bear no responsibility for any changes. In any case, the Visitor shall contact the Company to check for availability.
4. Common final provisions
4.1If one of the terms of the GTC is or becomes inapplicable or does not regulate a point, the validity of the remaining provisions shall not be affected. A provision that comes as close as possible to the economic purpose of the present GTCs shall be incorporated to replace the ineffective provision or to fill the gap.
4.2 The present GTCs are governed by Greek law and the courts of Athens shall be exclusivelycompetent for any contractual or other dispute in connection with the Company’s GTCs.
4.3 Greek law applies to the relations arising from the present GTC, with the exception of the rules of conflict of law.
4.4 The Company reserves the right to amend the present GTCs to the extent necessary and in any reasonable manner for the Visitor with respect to the elimination of consequential disruptions to the equivalence of the basic obligations, adaptation to the amended legislative or technical framework conditions, where this is acceptable for the Visitor, especially in the case of changes that do not constitute an adverse change for the Visitor.

The Company shall not be obliged to participate and does not participate in dispute settlement proceedings before a consumer arbitration body.
